COVID-19 TERMS, WAIVER AND RELEASE OF LIABILITY FOR ATI’S 2022 NATIONAL NURSE EDUCATOR SUMMIT 

Carefully review the following Updated Terms, Waiver and Release of Liability.

UPDATED COVID-19 Terms, Waiver and Release of Liability for ATI’s 2022 National Nurse Educator Summit  (this “Terms, Waiver and Release”).

Please carefully review this Terms, Waiver and Release, which supplements and replaces any earlier version that you previously accepted.

By registering for the 2022 National Nurse Educator Summit (the “Summit”), you agree to the following terms of Assessment Technologies Institute, LLC (“ATI”) regarding your participation in the Summit and related COVID-19 health practices and risks. 

In the interest of our Summit attendees’ health and safety, ATI is committed to following the guidance and standards of the CDC, WHO and national, state and local health authorities related to COVID-19. As COVID-19 prevention protocols and standards continue to develop and evolve, ATI will provide information about what to expect onsite during our event. This information was originally be delivered to attendees on or about March 1, 2022 and will continue to be updated as ATI deems necessary. This may include health and COVID-19 exposure questions as permitted by law and privacy regulations, as well as requirements regarding COVID-19 vaccination status. COVID-19 testing, wearing of PPE, distancing procedures and other health-related measures being instituted during the event.

IMPORTANT UPDATE:

ALL SUMMIT ATTENDEES MUST BE FULLY VACCINATED IN ORDER TO ATTEND THE SUMMIT IN-PERSON. If you plan to attend the Summit in person, you will be required to provide proof that you are fully vaccinated by submitting such proof to ATI’s event partner, Cvent, for verification, in accordance with instructions provided by ATI. You will receive step-by-step directions on how to complete this process. ATI will not be collecting or storing your personal health information. This will all be done through our Cvent and its verification provider ID.me. You will receive notice from Cvent or ATI once your vaccination status has been cleared for your Summit attendance. If you do not receive notice that your vaccination status has been verified for Summit attendance, you will not be permitted to attend in-person. ATI will provide virtual options for Summit  attendees who are not vaccinated or for those who choose to virtually attend for other reasons. For purposes of this vaccination protocol, the Summit uses the CDC’s definition of “fully vaccinated”, which means 2 weeks after the second dose in a 2-dose series, such as the Pfizer or Moderna vaccines, or2 weeks after a single-dose vaccine, such as Johnson & Johnson’s Janssen vaccine.

We will provide any important information and updates on state and local public health requirements that apply to  the Summit. ATI may impose its own additional COVID-19 safety protocol, which may be in addition to those established by federal, state and local government.  For more information and additional resources, please click here.

Your COVID-19 Obligations

You agree that you will evaluate your own health, and the health of the people with whom you live and associate, before attending the Summit and you will not attend if you feel sick or have concerns that you may have been exposed to COVID-19.  You will not attend if you, or someone with whom you live, currently have, or within 14 days prior to the Summit have had, symptoms of COVID-19, such as fever, cough, shortness of breath or other symptoms. You will not attend the Summit if, during the 14 days prior to the Summit, you traveled anywhere that has experienced a sustained community spread of COVID-19.  If you feel sick during the Summit, you will not participate in any Summit events or socialize with Summit attendees, and, instead, you will self-isolate and seek appropriate medical attention.

During the Summit, you will be required and agree to complete and submit  your responses to a daily health questionnaire, including without limitation, providing your daily attestation regarding your health and COVID-19 and confirming your continued commitment to comply with the Summit’s COVID-19 safety protocol.

During the Summit, you will be required to, and you agree to,  wear a mask covering your nose and mouth at all times unless you are eating or drinking or during your presentation if you are a scheduled Summit speaker.

During the Summit, you agree to adhere to all national, state and local health and safety guidelines and policies regarding prevention of COVID-19 infection and spread, as well as those implemented by ATI, the host facility, and our partners throughout all portions the Summit.  ATI will issue attendance guidelines directly to all attendees prior to the event. These may include, but are not limited to, signing in to all sessions and activities for contact tracing, and maintaining recommended social distancing, to name a few. You understand and agree that, if you do not adhere to the guidelines and policies, you will be required to leave the Summit out of consideration for the well-being of all Summit attendees, staff, and partners.

If you test positive for COVID-19 within the 14 day period following the last day of the Summit, within 24 hours after receiving your positive test results, you will contact ATI at aticommunications@atitesting.com to let us know, so that we can facilitate contact tracing.

Your Waiver and Release of Liability

ATI will implement health and safety measures consistent with CDC and WHO guidance to help reduce the risk of COVID-19 infection during the Summit. Even the most robust measures, however, cannot guarantee that event participants will not become infected with COVID-19. By registering for the Summit, you acknowledge that there are risks in attending this Summit, including without limitation bodily injury, sickness, and death, and you knowingly and freely assume all risks of being exposed to or contracting COVID-19 and you fully accept such risk by registering for and attending the Summit.

As a condition of your attendance at the Summit, you waive any and all rights against, and you hereby release, covenant not to sue, discharge, and hold harmless, the 2022 National Nurse Educator Summit, ATI, other Summit attendees, owners and operators of any property where Summit events are held,  partners, vendors, Hyatt Regency Hotel, and each such party’s respective officers, employees, affiliates, contractors, agents, successor, heirs and assigns from and against any and all claims, suits, demands, losses, damages, expenses or liability (“covered claims”) of any kind that you, your heirs, assignees, next of kin, or legally designated or appointed representatives may have arising from or as a result of your participation in, presence or attendance at the ATI 2022 National Nurse Educator Summit, including but not limited to any covered claims arising out of or related to illness, injury or death associated with COVID-19 infection. This release applies even if liability results from the fault, actions, omissions or negligence of ATI or any third party. You agree that ATI has no responsibility or obligation to provide any financial, medical, health, disability or other assistance to you if you sustain any injury or illness as a result of attending the Summit. This COVID-19 Terms, Waiver and Release of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

Your Agreement

This COVID-19 Terms, Waiver and Release is the sole and entire agreement between you and
ATI regarding the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, and representations, both written and oral, with respect to such subject matter. If any term or provision of this COVID-19 Terms, Waiver and Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this COVID-19 Terms, Waiver and Release or invalidate or render unenforceable such term or provision in any other jurisdiction. This COVID-19 Terms, Waiver and Release is binding on and shall inure to the benefit of the ATI and you and our respective successors, heirs, executors and assigns. All matters arising out of or relating to this COVID-19 Terms, Waiver and Release shall be governed by and construed in accordance with the laws of the State of Kansas without giving effect to any choice or conflict of law provision or rule (whether of the State of Kansas or any other jurisdiction). Any claim or cause of action arising under this COVID-19 Terms, Waiver and Release may be brought only in the federal and state courts located in Kansas and you hereby consent to the exclusive jurisdiction of such courts.

BY COMPLETING THE REGISTRATION FOR THE 2022 NATIONAL NURSE EDUCATOR SUMMIT AND PROVIDING YOUR E-SIGNATURE, BELOW, YOU ACKNOWLEDGE CAREFULLY READING AND FULLY UNDERSTANDING ALL PROVISIONS OF THIS COVID-19 TERMS, WAIVER AND RELEASE AND FREELY AND KNOWINGLY ASSUMING THE RISKS AND WAIVING AND RELEASING THE RIGHTS DESCRIBED ABOVE. ATI MAY REQUIRE THAT YOU MANUALLY SIGN THIS UPON YOUR ARRIVAL AT THE SUMMIT AND YOU WILL COMPLY WITH SUCH REQUIREMENT.
